Some legal notes
Some residents have questioned whether last week’s vote on the tax rate was legal or not. Here is part of a response from County Attorney Jacob Stroman:
The Board’s vote last Tuesday on the real estate tax rate to be included in the tax rate resolution was entirely legal; any suggestion to the contrary is simply incorrect.
The Code of Virginia specifies that the Board must hold a public hearing on the budget at least seven days before adoption…the Code further provides that the Board must approve the budget and fix the tax rate(s) “no later than the date of which the fiscal year begins” (in Spotsylvania’s case, July 1).
