Update: Judge upholds School Board ruling
Spotsylvania Circuit Judge Joseph Ellis today quizzed school officials about how they investigated the case of Andrew Mikel, the Spotsylvania High School freshman suspended for the year after shooting plastic balls at classmates through a plastic tube.
He also challenged Andrew’s attorney to tell him how the School Board exceeded its authority, acted arbitrarily or capriciously, or abused its discretion.
Ultimately, the judge – who had little legal latitude – sustained the board’s actions and dismissed the case.
