Mikel case in recess pending ruling
UPDATE (2:43 p.m.) – The judge has upheld the School Board’s decision.
The case of the Spotsylvania High School freshman who was suspended for the remainder of the school year after hitting classmates with plastic pellets he shot through a plastic tube just went into break.
The hearing started at 10:35 this morning and broke at 12:41 p.m. for the judge to review a binder that includes information about each step of the case and ninth grader Andrew Mikel II’s school records.
At issue is whether the Spotsylvania School Board acted arbitrarily or capriciously, abused its discretion, or exceeded its authority when it gave Andrew a long-term suspension that stretched from December until the next school year.
The judge is expected to rule this afternoon.
