Federal judge has not ruled on motion-to-dismiss yet
A federal judge has issued a court order that all discovery be stayed and the deadlines set in a pretrial order be suspended, in Calvary Christian Center’s case against the city, according to court documents.
The church that brought a discrimination suit against the city for not issuing it a special-use permit, but agreed to drop it if the city issued the permit when it reapplied. The city council denied the permit after the planning commission recommended the denial and city staff reversed its earlier recommendation.
The city filed a motion to dismiss, but there hasn’t been a ruling on it yet.
The trial, scheduled for Dec. 8, is still on, pending the result of the motion-to-dismiss ruling.
