Judge: Calvary Church case not likely to succeed

Judge John A Gibney Jr. denied Calvary Christian Church a preliminary injunction in its First Amendment discrimination case against the city.

“The court finds that Calvary has not met the burden required to obtain a preliminary injuction,” the opinion read.

The judge states throughout the 22-page opinion the reasons why the church’s case would not be successful.

The church alleged that the city discriminated against it in denying it a special-use permit to open a daycare for disabled children.

The three city council members–Kerry Devine, Brad Ellis and Mary Katherine Greenlaw–who voted against the permit defended and explained their decision.

Pastor Hirsch and Ed Murphy, director of Fairwinds (the school) testified as well.
